Terms of service
These terms describe the understanding between you and lovekept when you order a personalized keepsake from us, or purchase through one of our partner storefronts. They’re written to be read, not to intimidate — if anything here is unclear, ask us.
By placing an order with lovekept, or through a partner storefront powered by lovekept, you agree to these terms.
Who can order
You must be at least 18 years old, or the age of majority in your state, and able to enter into a binding contract to place an order with us.
Made to order
Every piece is personalized and made to order. When you place an order you’re asking us to create something that doesn’t exist yet, from the names, dates, words, and photographs you provide. Because of this, personalized orders are generally not eligible for cancellation once production has begun, except as described under Our responsibility below.
Your content
You confirm that you have the right to use the photographs and text you place on a piece — that they’re yours, or that you have permission from whoever holds the rights, including, where applicable, permission from the family or estate of the person being memorialized. You keep all rights to your photographs and words; you grant us only the limited permission needed to prepare, print, and deliver your keepsake, and to keep the records described in our privacy policy.
Our review
We review every piece by hand before printing. We may decline to produce content that is unlawful, hateful, or that we reasonably believe infringes someone else’s rights — if that ever happens, we’ll tell you plainly and refund you in full.
Accuracy
The preview you approve is what we print. Please check names, dates, and spellings carefully — they will appear on the finished piece exactly as you entered them. Our hand review is a safety net for things that look wrong, but it cannot know a spelling you intended.
Prices and payment
Prices are shown before you pay, and payment is taken when you place your order. If we cancel an order for any reason, you receive a full refund. Cancellations, damaged deliveries, and returns are covered on the shipping & returns page, which forms part of these terms.
Partner storefronts
Some orders are placed through a storefront operated by one of our partners — a funeral home, pet crematorium, or similar business we work with. Where that’s the case:
- The partner sets the price. Each partner independently chooses the pricing shown on their storefront. lovekept does not control, and is not responsible for, a partner’s pricing decisions.
- The partner is the seller. Your purchase contract is with the partner named on the storefront, not with lovekept. lovekept manufactures and fulfills the keepsake on the partner’s behalf, but the partner is responsible for the sale itself, including any additional terms, taxes, or policies they add.
- Our terms still apply to production. The sections of this agreement covering Made to order, Your content, Our review, Accuracy, and Delivery estimates apply to how we make and ship your piece, regardless of which storefront you ordered from.
- Questions about a specific order are best directed first to the partner you purchased from; they can loop us in if it’s something we need to handle directly.
Delivery estimates
Production and delivery times are honest estimates, not guarantees. If your order carries a service date we watch it closely, and if we believe a date is at risk we will contact you promptly — but we cannot accept liability for a carrier’s delay once a piece has shipped.
Our responsibility
If we get something wrong — a piece that doesn’t match the approved preview, or arrives damaged — we will remake it at no cost or refund you in full, whichever you prefer.
Except for that promise, and to the fullest extent permitted by law, we provide our products and services “as is,” without warranties of any kind, express or implied, including any implied warranties of merchantability or fitness for a particular purpose. Some states don’t allow the exclusion of certain implied warranties, so parts of this may not apply to you.
Beyond the remedy above, our total liability for any order is limited to the amount you paid for it. We are not liable for indirect, incidental, or consequential damages arising from your order. Nothing in these terms limits liability that cannot lawfully be limited, including liability for gross negligence, willful misconduct, or personal injury caused by a defective product.
Our intellectual property
The lovekept name, logo, site content, and designs (other than the personal names, dates, words, and photographs you provide) belong to lovekept or its licensors. You may not copy, reproduce, or use them without our written permission.
Acceptable use
You agree not to use the site to submit content that is unlawful, infringing, or that impersonates another person, and not to attempt to disrupt, reverse-engineer, or gain unauthorized access to the site or our systems. We may suspend or refuse service to anyone who violates this.
Indemnification
You agree to reimburse and hold lovekept harmless from claims, losses, or expenses (including reasonable attorney’s fees) arising from content you submit without the right to use it, or from your violation of these terms.
Circumstances beyond our control
We’re not responsible for delays or failures caused by events outside our reasonable control — natural disasters, carrier disruptions, material shortages, and similar events.
Changes to these terms
We may update these terms from time to time. Changes apply to orders placed after the update is posted; we’ll always show the current version on this page.
Governing law
To be completed by the owner: state of incorporation/principal place of business, for the governing law and venue clause (e.g., “These terms are governed by the laws of the State of ___, without regard to conflict-of-law principles, and any dispute will be resolved in the state or federal courts located in ___ County, ___.”)
Consider with your attorney whether to add an arbitration clause and class-action waiver — common on DTC sites, but with tradeoffs worth discussing given the emotionally sensitive nature of your product.
General
If any part of these terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision isn’t a waiver of it. These terms, along with our privacy policy and shipping & returns page, make up the entire agreement between you and lovekept regarding your order. You may not assign these terms without our consent; we may assign them in connection with a merger, sale, or transfer of our business.
